1 Acceptance of Terms
By accessing or using the ResumeStore platform at resumestore.in (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree with any part of these Terms, you must not use the Platform.
These Terms, together with our Privacy Policy, govern your relationship with ResumeStore. Where a separate signed Service Agreement exists between you and ABSLT, the Service Agreement shall prevail in the event of conflict.
2 About ResumeStore
ResumeStore is a candidate database software operated by ABSLT (Proprietorship Firm), Udaipur, Rajasthan, India. The Platform enables companies and recruiters to store, parse, search, and rediscover candidate resumes using AI-powered tools. It is designed for internal recruitment and talent acquisition purposes.
3 Account Registration
3.1 To use the Platform, you must be registered by our team. Account access is provisioned via email, and authentication uses passwordless magic links — we do not collect or store passwords.
3.2 You are responsible for maintaining the security of the email address associated with your account, as it is used for authentication. Each team member must have their own login — account sharing is not permitted.
3.3 You are responsible for all activity that occurs under your account, including actions taken by team members you invite. Notify us immediately at mansi@resumestore.in if you suspect unauthorised access or if a team member leaves your organisation.
4 Services & Credits
4.1 ResumeStore operates on a credit-based model. Credits are consumed when resumes are uploaded and parsed by our AI engine (1 credit = 1 resume parsed). Credits are not consumed for AI search, candidate self-updates, or job applications received through public job links.
4.2 Credits are purchased in advance through one of our plans (Starter, Growth, Pro, Business) or as specified in a separate Order Form. Access to the Platform requires an active subscription.
4.3 Credits do not expire. Purchased credits remain in your account until used. You may top up at any time.
4.4 All plans include unlimited AI search, bulk upload (up to 50 resumes at once), team access, WhatsApp and email outreach, candidate self-update portal, job opening management, LinkedIn post generation, structured resume PDF generation, and duplicate detection.
4.5 We reserve the right to modify, enhance, or discontinue features of the Platform at any time.
5 Fees & Payment
5.1 All fees are as displayed on our pricing page or as agreed in a signed Order Form. Prices are exclusive of applicable taxes (including GST) unless stated otherwise.
5.2 Payment is required in advance before credits are activated. We are not obligated to provide Services until payment is received.
5.3 Credits are non-refundable and non-transferable. Credits may not be exchanged for cash or transferred to another account.
5.4 We may revise pricing by providing at least 30 days’ notice. Revised pricing applies to new purchases only and does not affect credits already purchased.
5.5 You are responsible for all applicable taxes, including GST. If you are required to withhold any tax (e.g., TDS), you must pay additional amounts so that we receive the full invoiced amount.
6 Your Data & Responsibilities
6.1 Ownership: You retain all rights to the data you upload (“Client Data”). By uploading data, you grant us a limited licence to host, store, process, index, and display it solely to provide the Services.
6.2 Your Warranties: You represent and warrant that:
- You have all necessary rights, consents, and legal authority to upload the data.
- The data does not infringe any third-party rights or violate any applicable law.
- You have obtained necessary consent from candidates whose data you upload, in compliance with the DPDP Act, 2023 and other applicable laws.
6.3 Accuracy: We do not verify the accuracy or legality of data you upload. You are solely responsible for data quality.
7 Data Security & Privacy
7.1 We are committed to protecting your data. Our security measures include encryption (TLS 1.2+ in transit, AES-256 at rest via AWS S3), passwordless magic-link authentication, role-based access controls, multi-tenant data isolation scoped by organisation ID, API rate limiting, audit logging, and India-based data residency (AWS ap-south-1 Mumbai).
7.2 Our full data practices are described in our Privacy Policy, which forms part of these Terms.
7.3 For the purposes of the DPDP Act, 2023: you are the Data Fiduciary and we act as your Data Processor. We process personal data solely on your behalf and in accordance with your instructions as set out in these Terms. Resume content is sent to AI providers (Anthropic and OpenAI) for parsing, embedding, and matching — these providers process data transiently and do not retain it.
7.4 In the event of a confirmed data breach, we will notify affected clients within 72 hours and take immediate steps to mitigate the impact.
7.5 Upon account termination, we retain your data for 30 days (for export in CSV/JSON format), then permanently delete it from active systems within 30 days, with backup purge within a further 90 days.
8 Acceptable Use
You agree not to:
- Scrape, crawl, or use automated tools to extract data beyond your authorised API and credit usage.
- Use the Platform for any unlawful, discriminatory, or abusive purpose, including employment discrimination or candidate harassment.
- Reverse engineer, decompile, or attempt to extract the source code or algorithms of the Platform.
- Attempt to circumvent security, rate-limiting, or access controls.
- Use the Platform to build or train a competing product.
- Introduce viruses, malware, or other harmful code.
- Exceed fair-use API rate limits or usage quotas.
- Use the Platform for unsolicited bulk messaging or spam to candidates.
9 Intellectual Property
9.1 The Platform — including its software, algorithms, AI models, user interface, design, documentation, and all related intellectual property — is and remains the exclusive property of ABSLT.
9.2 These Terms grant you only a limited, non-exclusive, non-transferable, revocable right to use the Platform during your active subscription. No other rights are granted.
9.3 You shall not claim any intellectual property rights over the Platform, its features, outputs (such as parsed data structures or match scores), or any technology underlying the Services.
9.4 If you provide feedback or suggestions about the Platform, you grant us a perpetual, irrevocable, royalty-free licence to use such feedback without obligation.
10 Third-Party Services
The Platform may integrate with or link to third-party services (e.g., WhatsApp for candidate outreach, payment gateways). We are not responsible for the availability, accuracy, or practices of third-party services. Your use of such services is subject to their own terms and policies.
11 Disclaimers
The Platform and Services are provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding:
- The accuracy, completeness, or reliability of resume parsing, search results, or match scores.
- Uninterrupted, error-free, or secure access to the Platform.
- Fitness for any particular purpose or merchantability.
12 Limitation of Liability
12.1 To the maximum extent permitted by law, ABSLT shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, business, or goodwill, arising from your use of the Platform.
12.2 Our total aggregate liability shall not exceed the total fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.
12.3 We shall not be liable for any hiring decisions, employment outcomes, or candidate-related claims arising from your use of data obtained through the Platform.
13 Indemnification
You agree to indemnify, defend, and hold harmless ABSLT, its proprietors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Platform.
- Any breach of these Terms by you or your authorised users.
- Any violation of applicable law or third-party rights by you.
- Any claims arising from the data you upload, including claims by candidates or data subjects.
- Any unauthorised access to the Platform caused by your failure to secure account credentials.
14 Term & Termination
14.1 These Terms are effective from the date you first access the Platform and remain in effect until your account is terminated.
14.2 You may terminate your account at any time by contacting us at mansi@resumestore.in.
14.3 We may terminate or suspend your account immediately if you breach any material term of these Terms, engage in prohibited conduct, or if required by law.
14.4 Upon termination: access to the Platform ceases immediately; unused credits are forfeited (unless we terminated without cause, in which case a pro-rata refund of unused credits may apply); your data is handled per the retention and deletion schedule in Section 7.5.
14.5 Sections relating to Intellectual Property, Limitation of Liability, Indemnification, Data Retention, and Governing Law survive termination.
15 Governing Law & Disputes
15.1 These Terms are governed by the laws of India, without regard to conflict-of-law principles.
15.2 Any dispute shall first be attempted to be resolved through good-faith negotiation for thirty (30) days.
15.3 If unresolved, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with a sole arbitrator, seated in Udaipur, Rajasthan.
15.4 Either Party may seek injunctive relief from the courts in Udaipur, Rajasthan to prevent irreparable harm pending arbitration.
15.5 The courts of Udaipur, Rajasthan shall have exclusive jurisdiction over matters not covered by arbitration.
16 General Provisions
16.1 Entire Agreement: These Terms, together with the Privacy Policy and any signed Service Agreement or Order Form, constitute the entire agreement between you and ABSLT.
16.2 Amendments: We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 15 days in advance. Continued use constitutes acceptance.
16.3 Severability: If any provision is held unenforceable, the remaining provisions continue in full force.
16.4 Assignment: You may not assign or transfer your account or rights without our written consent. We may freely assign these Terms.
16.5 Waiver: Failure to enforce any right does not constitute a waiver of that right.
16.6 Force Majeure: Neither party is liable for delays caused by events beyond reasonable control, including natural disasters, pandemics, government actions, cyberattacks, or internet outages.
16.7 Relationship: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and ABSLT.
